Terms and Conditions
Aim and determination of the general conditions
– The aim of these general conditions, just like the order form and the other elements referred to in the conditions, is to regulate the terms and the conditions of the provision of services of the Online Store of Influente & Peculiar Unipessoal Lda., whose physical address is Rua do Mirante 139, Zip Code 4900-837, Viana do Castelo, Portugal, with the collective enterprise # 516 224 450, and 4,500.00 € as capital social.
– Buying any product in the Online Store implies the acceptance of these General Conditions of Online shopping.
– All the alcoholic beverages available for shopping on the Online Store may only be purchased by those who are of legal drinking age in their country of residence.
Information about products, prices, and contents
– Influente & Peculiar reserves the right to modify, with no previous notice and at any moment, the information and the commercial availability of: products, prices, promotions, services and commercial conditions.
– Images illustrating any product of the Online Store may differ from the product subsequently delivered, and the products may be out of stock.
– Despite our efforts, some products may show an inaccurate price, and for this reason we always verify the prices whenever we are dealing with an order. As a consequence, the prices shown are merely a representation and so they do not comprise any contractual agreement. If the real price of the product is lower than the price shown the difference in price will be returned to the customer. If the price is higher, the company will inform the customer by e-mail, and we will wait until the customer decides whether he wants to accept the new price or if he prefers to cancel the order within 15 days after receiving the message.
– In accordance with Portugal’s legislation, all the prices shown include current VAT and fees, unless otherwise noted.
Payment
– We accept payment by MB Way and credit or debit card.
– Regardless of the country and currency used by the customer, all payments must be made in Euros. Customers are totally responsible for all foreign currency exchange rates.
Shipping and packaging costs
– Shipping costs, as well as the conditions applicable to each destination, are those set out on the customer support page, and vary according to the quantity and the destination of the order.
Legal Notices
– In accordance with Decreto-Lei n.º 143/2001 and Decreto-Lei 82/2008 from 20/05, Influente & Peculiar bestows the customer the exercise of the right of contract resolution, allowing a period of 14 (fourteen) days to exercise the right to return the merchandise.
– All contractual provisions defined above are governed by Portuguese law. The courts of Portugal shall have sole jurisdiction to settle any dispute or interpretation of the General Terms and Conditions for Online Sale.
– We hereby inform you that in case the customer does not reside in Continental Portugal, any legal dispute has to go through in the court systems of Portugal.
– In regard to Decreto-Lei n.º 144/2015, from September 8th, we inform that the litigation institution is the Centro de Arbitragem de Conflitos de Consumo – Braga (CIAB – Tribunal Arbitral)
